PlayStation Fans Archive Sony Statements on Game Ownership

TOKYO, September 12 — PlayStation users have built a public archive of Sony’s own past statements that customers “own” their purchased games, pairing that promotional language with receipts and transaction records. The documentation effort traces back to Sony Interactive Entertainment’s 2021 decision to shut down the PlayStation Store on the PlayStation 3, PlayStation Portable and PlayStation Vita — and to the gap it exposed between marketing and license terms. The mechanics here are straightforward.

Sony announced on March 29, 2021 that it would close the PlayStation Store for the PS3 and PSP on July 2, 2021, and for the PS Vita on August 27, 2021. After sustained backlash, the company reversed course on April 19, 2021, keeping the PS3 and PS Vita stores open for purchases of games and add-on content.

The PSP store closed as planned on July 2, 2021. The reversal was announced by then-Sony Interactive Entertainment President and CEO Jim Ryan.

What the archive actually documents

The fan archive is a form of consumer documentation and advocacy, not litigation. Its organizers say they want transparency and preservation. What they have assembled is a record of Sony’s own promotional language — statements that users can “own” or “keep” games — set against the receipts and order confirmations that customers received at the point of sale.

The catch is legal, not technical. Digital purchases are generally licenses governed by terms of service, not sales of copyrighted works.

That distinction is what the archive is designed to expose: the same transaction can be described as a purchase in marketing and as a license in the fine print. The US Copyright Office has examined the issue of digital ownership, and consumer groups have pushed for clearer labeling.

Sony’s own precedent, and the industry’s

The 2021 episode echoed a 2019 incident in which Sony removed purchased movies from users’ accounts in Germany and Austria. The company cited licensing arrangements with content providers. Storefront shutdowns are not unique to Sony.

Nintendo closed the Wii Shop Channel in 2019 and the 3DS and Wii U eShops in March 2023. Microsoft has shut down the Xbox 360 Marketplace.

Sony’s PlayStation Plus subscription service, launched in 2010, and its 2022 revamp into tiered plans, further blurred the line between ownership and access. Games downloaded through the service remain available only while a subscription is active. On closer reading, the archive tests a narrow question with broad consequences.

As consoles age and online services end, what happens to purchased digital libraries? Sony has not announced a new closure of legacy stores beyond the 2021 episode, and the PS3 and PS Vita stores remain open for purchases as of the company’s 2021 reversal.

Watch whether regulators and platforms move on labeling. The archive’s value is that it makes the promise and the license terms sit on the same page — and that is precisely where the industry’s next fight over digital ownership will be fought.
